Legal status

The sale of psychoactive products often raises questions about their legality. This is understandable – and that's why we believe it's important to be transparent about what is and isn't permitted, both in the Netherlands and abroad.

On this page we briefly explain the legal situation regarding:

  • Psilocybin truffles (sclerotia)
  • Mushroom grow kits (kits with mycelium, spores or substrate)

We will discuss the Dutch legislation, the international treaties (such as the UN Convention on Psychotropic Substances), and the EU rules for cross-border sales (Regulation 2019/515).

Psilocybin truffles

1. What are truffles?

Magic truffles (sclerotia) are underground storage organs of certain fungi species that can naturally contain psilocybin. Unlike magic mushrooms, truffles are not regulated by the Opium Act in the Netherlands and are therefore completely legal to buy, possess, and use.

We only sell fresh truffles that are legal under Dutch law. Use is entirely at your own risk.

2. Legal in the Netherlands

Magic truffles (sclerotia) are completely legal in the Netherlands. Since the 2008 mushroom ban, mushrooms containing psilocybin have been prohibited, but truffles are not. Legally, truffles are not considered magic mushrooms because they are a different growth form (underground) and are not explicitly listed in Schedule I of the Opium Act. Therefore, truffles can be legally sold, purchased, and used in the Netherlands.

3. International legislation:

According to the UN Convention on Psychotropic Substances (1971), active substances such as psilocybin are prohibited, but natural sources such as truffles are not explicitly mentioned. Article 32(12) of the Convention excludes natural plants/fungi from the prohibition requirement, as long as the active substance has not been extracted from them.

4. Sales within the EU

Our products are legally marketed in the Netherlands. Based on Regulation (EU) 2019/515 on the mutual recognition of goods, products that are legal in one EU Member State may in principle also be offered in other EU countries.

Please note, however, that national authorities may apply additional regulations. Therefore, it is the customer's responsibility to check the legislation in their own country before purchasing or using it.

The legality of mushroom grow kits

1. What are grow kits?

Grow kits typically contain mycelium, spores, and/or substrate. This allows users to cultivate mushrooms that may contain psilocybin at home. Our grow kits do not contain psilocybin or psilocin at the time of sale and therefore comply with Dutch law. Use is entirely at your own risk.

 

2. Situation in the Netherlands

Grow kits are permitted in the Netherlands, as long as they don't contain any active ingredients. The Opium Act only prohibits psilocybin, psilocin, and fresh magic mushrooms. Mycelium, spores, and substrate are not included.

 

3. International legislation:

It UN Convention on Psychotropic Substances (1971) Prohibits psilocybin and psilocin, but not the natural organisms (spores, mycelium) from which they can be produced. Article 32(12) confirms that natural plants and fungi are exempt from the prohibition, as long as the active substances have not been extracted or synthesized from them.

 

4. Sales within the EU

Although grow kits are permitted in the Netherlands, the situation may differ in other EU Member States. The principle of mutual recognition (Regulation (EU) 2019/515) may theoretically apply, but Member States may still restrict imports or sales on the grounds of public health or public order.
